JVP Asks Election Commissioner Not To Call Presidential Election

A delegation of Janatha Vimukthi Peramuna today met the Election Commissioner and told him that the incumbent president holding a snap poll when two years are still left of his second term is unconstitutional.

JVP Representatives including the General Secretary Tilvin Silva and Political Bureau members Vijitha Herath and Sunil Handunneththi today met the Election Commissioner Mahinda Deshapriya and handed over a letter in this regard.

The JVP in the letter, pointing out that Commissioner of Elections has the authority to hold a presidential election, asked the Commissioner to refrain from announcing such an illegal presidential election.

The JVP pointed out that the Constitution that was effective when the President elected for the second term on 26th January 2010, clearly stated that no person who have served twice is qualified to be elected for another term.

When the Constitution was amended to include the 18th Amendment on 9th September 2010, the incumbent president had already become disqualified to get elected as president and his disqualification had not been removed by the 18th Amendment, the JVP explained.

Therefore, the party argued that the President Rajapaksa coming forward as a candidate for a presidential election is illegal.

There is no provision in the law to hold a presidential election in four years before the second term of six years of presidency has been completed, the JVP noted. A president serving the second term should complete the six year period and cannot call elections earlier JVP has said.
