No Impeachment Process Needed To Remove President Under 19th Amendment

According to the proposed 19th Amendment to the Constitution, the president can be removed by a 2/3 majority in parliament by a no-confidence motion, without going through the complex impeachment process, Minister DM Swaminathan stated.

Speaking to BBC Tamil Service, he added that the Prime Minister will become the head of the Cabinet. However, the president will still be Minister of Defence, Minister of Mahaweli Development and Minister of Minister of Environment.

He will continue to be the Head of State and Commander-in-Chief of armed forces. The President can hold office only twice and the duration of a term will be five years.

The electoral system will be changed in to a mixed system, Swaminathan said.

The Prime Minister can ask for the appointment of a Deputy Prime Minister if he requires.

Meanwhile, the Cabinet of Ministers will be limited to 30. The number of Ministers of State and Deputy Ministers are limited at 40.

Significantly, the president loses the power to dissolve the parliament at will. According to the present situation, the president can dissolve parliament any time after the first year of its term. However, the 19th Amendment stipulates that the parliament can be dissolved only after five and a half years of its term, by a 2/3 majority.
